DMCA & Copyright Policy

Central Yacht Agent Inc. (“Central Yacht Agent”, “CYA”, “we”, “our”, or “us”) respects the intellectual property rights of others and expects users of our website, applications, APIs, and services (collectively, the “Platform”) to do the same.

This Copyright Policy explains our procedures for responding to claims of copyright infringement in accordance with the United States Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.


1. CYA’s Role as a Service Provider

Central Yacht Agent operates as a technology platform that allows yacht brokers, yacht managers, charter companies, yacht owners, dealers, and other authorized users to upload, manage, distribute, and display content.

Much of the content appearing on the Platform is submitted by third parties.

Central Yacht Agent does not generally:

  • Create listing content.
  • Create photographs or videos.
  • Verify ownership of uploaded content.
  • Monitor all content prior to publication.
  • Determine ownership rights in submitted materials.

Users are solely responsible for ensuring they possess all necessary rights and permissions for any content they upload or distribute through the Platform.


2. Copyright Infringement Notification

If you believe that material appearing on the Platform infringes your copyright, you may submit a written DMCA Notice containing the following information:

Required Information
  1. A physical or electronic signature of the copyright owner or authorized representative.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the allegedly infringing material and sufficient information to permit us to locate it, including:
    • URL(s)
    • Listing ID(s)
    • Yacht name(s)
    • Screenshot(s) if available
  4. Your contact information:
    • Full legal name
    • Company (if applicable)
    • Mailing address
    • Telephone number
    • Email address
  5. A statement that:

“I have a good faith belief that use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law.”

  1. A statement that:

“The information contained in this notice is accurate, and under penalty of perjury, I am the owner, or am authorized to act on behalf of the owner, of an exclusive copyright interest that is allegedly infringed.”

4. Review Process

Upon receipt of a valid DMCA Notice, Central Yacht Agent may:

  • Investigate the claim.
  • Contact the content submitter.
  • Temporarily disable access to the content.
  • Remove the content.
  • Request additional information.
  • Take any action deemed appropriate under applicable law.

CYA reserves the right to determine what actions are appropriate in its sole discretion.


5. Counter-Notification Procedure

If you believe content was removed or disabled as a result of mistake or misidentification, you may submit a Counter-Notification containing:

Required Information

  1. Your physical or electronic signature.
  2. Identification of the material removed and its prior location.
  3. A statement under penalty of perjury that:

“I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.”

  1. Your name, address, telephone number, and email address.
  2. A statement that:

“I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if outside the United States, to the jurisdiction of any judicial district in which Central Yacht Agent may be found, and I will accept service of process from the person who submitted the original DMCA Notice.”

6. Repeat Infringer Policy

Central Yacht Agent reserves the right to suspend, restrict, or terminate accounts belonging to users who repeatedly infringe the intellectual property rights of others.

Factors that may be considered include:

  • Number of complaints received.
  • Validity of complaints.
  • User response history.
  • Severity of violations.

We reserve sole discretion in determining whether a user qualifies as a repeat infringer.


7. False Claims

Submitting knowingly false copyright claims or counterclaims may subject the submitting party to legal liability, including damages, costs, and attorney’s fees under applicable law.

Users are encouraged to consult legal counsel if uncertain regarding their rights.


8. Copyright Ownership Responsibility

By uploading content to the Platform, users represent and warrant that:

  • They own the content; or
  • They have obtained all necessary permissions, licenses, authorizations, and rights required for use and distribution.

Users remain solely responsible for any copyright disputes arising from content they upload.


9. Broker and Listing Content

Because the Platform serves the yacht industry, listing content may include:

  • Vessel photographs
  • Drone photography
  • Marketing videos
  • Virtual tours
  • Brochures
  • Specification sheets
  • Floor plans
  • Yacht descriptions

Users must ensure they possess all rights necessary to upload and distribute such materials through the Platform.


10. API and Syndication Services

Content distributed through the Central Yacht Agent API may be displayed on third-party websites and applications.

While CYA may remove content from its own Platform following a valid DMCA notice, we cannot guarantee immediate removal from third-party websites, search engines, archives, caches, or systems beyond our control.

Claimants may need to contact those third parties directly.


11. Search Engine and Cached Content

Removed content may continue to appear temporarily through:

  • Search engine caches
  • Archived pages
  • Third-party websites
  • Browser caches
  • Content delivery networks

Central Yacht Agent is not responsible for the timing of removal from external systems.


12. No Legal Determination

Central Yacht Agent does not act as a court or legal adjudicator.

The receipt of a DMCA Notice does not constitute a finding of infringement.

Likewise, the receipt of a Counter-Notification does not constitute a finding of non-infringement.

Disputes regarding ownership or licensing rights remain the responsibility of the parties involved.


13. Reservation of Rights

Central Yacht Agent reserves the right to:

  • Remove content at any time.
  • Refuse publication of content.
  • Suspend accounts.
  • Request proof of ownership.
  • Request licensing documentation.
  • Take actions necessary to protect the Platform and its users.

Nothing in this policy limits any rights available under applicable law.
